International law organization urges Italy and all EU member states to list IRGC as terror organization

On Tuesday February 25th, 2025, at a meeting in the Italian Senate in Rome, The Hague Initiative for International Cooperation (thinc.) urged the Italian government to make sure that the Islamic Revolutionary Guard Corps (IRGC) is listed as a terror organization in the EU.

thinc. is a global network of international lawyers that carries out research, education and advocacy concerning the fair and realistic application of international law in the Middle East.

In 2024, thinc. published a full report on the Legal Conditions for Inclusion of the IRGC on the EU Terror List.

Andrew Tucker, Director General of thinc.,stated in his speech today:

“In our view, both the High Representative and the Member States – including Italy -are obliged to take all necessary steps to ensure that the IRGC is placed on the EU terror list as soon as possible.

There is compelling evidence that global terrorism is a recurring element of Iran’s foreign policy, posing a significant threat to world peace and security. And there are numerous decisions by competent judicial and non-judicial authorities within the meaning of Article 1 (4) of Common Position 931.  

In our view there is no legal basis for the EU not to designate the IRGC as a terrorist group. In fact, in our view, the High Representative has a duty to initiate the proposal for the IRGC designation. A decision not to place IRGC on the list would be a political decision that not only violates the Common Position, it goes against the democratic will of the people of the European Union as expressed by recent resolutions of the EU Parliament calling on the Council to place the IRGC on the EU terrorist list.”
